  • Applications & Appeals

    Before submitting planning applications we always visit the site and discuss with and advise clients on the development potential, policy and legislative framework and the likelihood of obtaining consent. We take note of clients aims and objectives with any scheme and try to achieve these by working with the planning process. We have extensive experience of the preparation and submission of planning applications for all types of clients and for a wide range of development proposals. These range from house extensions to major residential and commercial developments.

    Where appropriate we can assemble and lead development teams consisting of specialist advisors. We have worked with leading architects, highway, structural and drainage engineers, landscape and arboricultural consultants. On behalf of clients we have also successfully co-ordinated the input of these other professionals into producing a scheme which has an enhanced chance of success with the planning authority. We aim to negotiate with planning authorities to achieve a positive decision rather than having to resort to the appeal process. An increasingly important aspect of the decision making process is developer contributions and we have experience of negotiating with local authorities together with appropriate legal advice on these issues.

    Many applications now require additional information to be submitted including comprehensive design and access statements, flood risk assessments and sustainability appraisals. We provide expertise to provide these additional documents.

    In the event of a refusal or other situations such as non determination, or unreasonable conditions upon approval there is a right of appeal and we specialise in handling all types of planning appeal. We have a successful track record in challenging decisions for clients. Appeals can be progressed by written representations, informal hearings and by public inquiry depending upon circumstances we can advise on the most appropriate method of appeal to be followed. If necessary we can appoint legal representation including specialist planning and property law barristers. If necessary we can instruct as we have the benefit of Direct Professional Access to the Planning Bar. On appeals we have also acted for clients including amenity groups and concerned local residents against development proposals.

  • Planning Policy


    Planning policy is a material consideration in assessing any development proposals. We are expert in giving advice to clients as to the most appropriate way of influencing policy.

    Local Development Frameworks are being introduced to replace current structure and local plans and we are assisting many clients with representations during the preparation process. It is vital that input into the process is made at the correct time and we can assist clients to ensure that opportunities are not missed. If necessary we have appeared at inspector’s inquiries to promote clients’ development proposals and aims and objectives for their land holdings. Representations have been made to Core Strategies, Strategic Residential Allocations, Small Site Allocations and Supplementary Planning Guidance.
     

  • Other Planning Matters

    Our professional services extends to more than just submitting planning applications and we have assisted clients with enforcement matters, advice on listed buildings and conservation area consents, tree preservation orders, Certificates of Lawful Development, agricultural and equestrian development including determinations, whole farm plans and viability assessments. This can sometimes include farm diversification, especially tourist related re-use of redundant farm buildings such as change of use to holiday let facilities. We also offer estate management advice. These need a specialist expertise which we provide to ensure a positive outcome and to achieve the client’s requirements.
